  • Chinese Judgments or Arbitration Awards Application in Taiwan                    

                    ◎  Association for Relations Across the Taiwan Strait and Strait Exchange Foun-
                          dation signed “Cross-Strait Joint Crime-Fighting and Judicial Mutual Assistance
                          Agreement” at Nanjing on April 26, 2009. Subject to the provisions of article 10
                          of this agreement, the parties agree that, based on the principle of reciprocity,
                          and under circumstances that do not contravene the public order or good morals,
                          they shall mutually recognize and enforce final and binding civil judgments and
                          arbitration awards(rulings).

                          This agreement was concluded in order to deepen further cross-strait judicial 
                          mutual assistance and mutual recognition and enforcement of civil judgments
                          and rulings.   

  • The Rules for Chinese Judgments or Arbitration Awards Application in Taiwan

                    ◎  An application for an irrevocable civil ruling or judgment, or arbitral award rendered
                          in the Mainland Area may be filed with a court for a ruling to recognize it and enforce
                          it in Taiwan, the following rules must be complied with:

                          1.Under circumstances that do not contravene the public order or good moralsof
                                  the Taiwan Area;

                          2.Based on the principle of equality and reciprocity:

                                  The recognition and enforcement of civil judgments and rulingsrendered in
                                  the Mainland Area shall not apply until the time when for any irrevocable civil
                                  ruling or judgment, or arbitral award rendered in the Taiwan Area, an application
                                  may be filed with a court of the Mainland Area for a ruling to recognize it, or it
                                  may serve as a writ of execution in the Mainland Area.

                          3.After “the Provisions on the People's Court's Recognition of the Verdicts on
                                  Civil Cases Made by Courts of Taiwan” being effective as of May 26, 1998,
                                  a civil judgment or arbitral award rendered in the Mainland Area could be
                                  enforced in Taiwan.

                          4.In regard to an application to the court for the recognition of a civil judgment
                                  or arbitral award rendered in the Mainland Area, verification by an institution
                                  set up or designated by the Executive Yuan or a private organization entrusted
                                  by the Executive Yuan shall be required.

                          5.Where any ruling or judgment, or award rendered in the Mainland Area
                                  recognized by a court's ruling requires performance, it may serve as a writ of
                                  execution.
