【Non-action litigation】
  • Judicial Yuan                                                                                                                           

                     ◎  Supreme Court

                          The Supreme Court exercises jurisdiction over the following cases:

                          1.appeals from judgments of High Courts or their branches in civil and criminal cases;

                          2.appeals from rulings of High Courts or their branches;

                          3.extraordinary appeals; or

                          4.any other case as specified by laws.

                     HighCourts 

                           The High Courts and its branches exercise jurisdiction over the following cases:

                           1.Criminal cases relating to rebellion, treason, and offenses against friendly relations
                                   with foreign states;

                           2.Appeals from judgments of the District Courts or their branches in ordinary proceedings
                                   of civil and criminal cases;

                           3.Interlocutory appeals from rulings of the District Courts or their branches in ordinary
                                   proceedings;

                           4.Other cases prescribed by law.

                    ◎  District Courts 

                          District Courts have jurisdiction over the following cases:

                         1.Ordinary or summary civil and criminal cases;

                         2.Non-contentious matters as specified by laws;

                         3.Othercaseson litigationprescribedby law.

                     Commission on the Disciplinary Sanctions of Functionaries

                            The Commission exercises jurisdiction over the caseson the disciplinarysanctions of functionaries,
                            including the salaried functionariesin civil and militaryservice, and service personnel in public
                            institutions, but except for staff of employment and full-time faculty in public schools.  

                    ◎  High Administrative Courts

                          Anyone who's right was unlawfully injured by government agency's administrative action is
                          entitled to file an administrative appeal before filingan administrative litigation to the Administrative
                          High Court, except for the litigation on revoking the administrative actionor the administrative
                          appealdecision and the litigation on imposing obligations. And the rest of the litigations for
                          affirming the legal relation and general payments, can appeal to theAdministrative High Court.
                          The general public can adopt different administrative remedies according to the types of events.

                    ◎  Supreme Administrative Court

                          A panel of fivejudges decides cases on appeals from judgments and rulings of High Administrative
                          Courts.

 

  • Ministry of Justice                                                                                                               

                    ◎  Prosecutor Offices

                          Its duties include crime detection, instituting public prosecution, executing public prosecution,
                          assisting private prosecution, undertaking private prosecution, commanding the execution of
                          criminal judgment and executing other duties prescribedby other laws.

                    ◎  Correctional Institutions

                          It is divided into seven categories: prisons, home for juvenile training and education, skills
                          training institutions, correctional schools, detention houses, juvenile guardian institutions, etc.

  • Investigatory Apparatus                                                                                                      

                    Be responsible for investigating safeguards issues related to endangering national security and 
                    violating national interests. The authority mainly carry out investigation and safeguards work like
                    ensuring national security, safeguarding national interests and the protection of public well-being
                    of the people.

  • Government Employee Ethics Department                                                                        

                    Be responsible for planning, supervision, examining and other national government ethics businesses.

                      ◎  Administrative Enforcement Authority

                         Decide on the enforcement of payment obligations, declaration of objection and supervision,
                         review, coordination, connection and other related legal matters.

                   ◎  Training InstituteForJudges and Prosecutors

                         Carry out training guideline, training programs, and other important matters related to training
                         on the personnel passed judicial examination.

                   ◎  Institute of Forensic Medicine

                         With responsibility for the test, appraisal and research of the evidence on body, pathology,
                         cause of death, poison, biology, pharmaceutical chemistry and serum exhibit; other research
                         and development matters on forensic medicine, and the training of forensic talents.

                   ◎  Training InstituteForRectification Personnel

                         With responsibility for formulation and implementation of the personnel's training programs 
                         and other training matters designated by the Ministry of Justice.
